1. INTRODUCTION

Welcome to Natural AI, an application ("App") designed to help you identify wildlife and natural elements and track your observations. The App is owned and operated by naturalai.online ("we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of the Natural AI App and our services.

By accessing or using the App, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not use the App.

2. ACCEPTANCE OF TERMS

By using the Natural AI App, you confirm that you are of legal age to form a binding contract in your jurisdiction. If you are using the App on behalf of a company or other legal entity, you represent that you have the authority to bind that entity to these Terms.

3. GOOGLE OAUTH 2.0 VERIFICATION REQUIREMENTS

This section outlines specific requirements to comply with Google's OAuth 2.0 policies.

• Privacy Policy Link: A link to our Privacy Policy is prominently displayed on our website's homepage, the App's login screen, and in the App's settings. The Privacy Policy clearly describes how we access, use, store, and share Google user data.

• Data Usage: Our use of Google user data is strictly limited to the practices disclosed in our Privacy Policy and adheres to Google's Limited Use requirements. We will only request the narrowest scopes necessary for the App's functionality.

• Project and Contact Information: We maintain up-to-date contact information for our project owners and editors in the Google Cloud Console.

• Domain Ownership: Our website (naturalai.online) is hosted on a verified domain that we own. This domain is used for our homepage and to host this Terms of Service and our Privacy Policy.

• Homepage: Our homepage accurately represents our brand and describes the functionality of the Natural AI App.

4. APP USE AND LICENSES

• Limited License: We grant you a limited, non-exclusive, non-transferable, and revocable license to use the Natural AI App for your personal, non-commercial use, subject to these Terms. You may not sell, resell, or otherwise exploit any part of the App for commercial purposes.

• Prohibited Activities: You agree not to:

  • Use the App for any illegal or unauthorized purpose.

  • Interfere with or disrupt the integrity or performance of the App.

  • Attempt to gain unauthorized access to our systems or user data.

  • Decompile, reverse engineer, or disassemble the App.

  • Use automated systems or software to extract data from the App without our express permission.

  • Post or upload any content that is obscene, defamatory, threatening, or otherwise objectionable.

  • Post or upload any content that infringes upon the intellectual property rights or privacy rights of any third party.

  • Upload or store sensitive personal information (SPI), as the App is not designed or intended to securely handle such data.

• User-Generated Content (Prompts, Journals, and Images): You retain all ownership rights to your content (including AI prompts, Journal Entries, and Images). However, by submitting content, you grant us a worldwide, non-exclusive, royalty-free, license to use, reproduce, and display your content strictly for the purpose of operating, maintaining, and providing the personalized features of the Natural AI App (e.g., storing your journal data in Firebase, generating AI responses via the Gemini API, and tracking achievements). We will not use your personal content (Journal Entries or Images) to train or improve the core Google AI models. We have the right, at our sole discretion, to remove any content that violates these Terms.

5. INTELLECTUAL PROPERTY

All intellectual property rights in the App and its content (excluding user-generated content) are owned by naturalai.online. This includes, but is not limited to, the software, design, logos, and trademarks. You may not use any of our intellectual property without our prior written consent.

6. DISCLAIMER OF WARRANTIES

The Natural AI App is provided on an "AS IS" and "AS AVAILABLE" basis. We do not make any warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the App will be accurate, error-free, or continuously available.

We specifically disclaim all liability for any errors or inaccuracies in the AI-generated content or wildlife/natural element identifications provided by the App. The information provided is for general knowledge and journaling purposes only and should not be relied upon for critical decisions.

7. LIMITATION OF LIABILITY

To the maximum extent permitted by law, naturalai.online shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your use of or inability to use the App; (b) any unauthorized access to or use of our servers and/or any personal information stored therein; (c) any interruption or cessation of transmission to or from the App; or (d) any bugs, viruses, or the like that may be transmitted to or through our App by any third party.

8. INDEMNIFICATION

You agree to defend, indemnify, and hold harmless naturalai.online, its officers, directors, employees, and agents, from and against any claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees) arising from: (a) your use of and access to the App; (b) your violation of any term of these Terms; (c) your violation of any third-party right, including without limitation any copyright, property, or privacy right; or (d) any claim that your user-generated content caused damage to a third party.

9. MODIFICATIONS AND TERMINATION

• Modifications to the Terms: We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms on this page. Your continued use of the App after any such changes constitutes your acceptance of the new Terms.

• Termination: We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the App will immediately cease.

10. GOVERNING LAW AND DISPUTE RESOLUTION

These Terms shall be governed by the laws of England and Wales , without regard to its conflict of law provisions. Any dispute arising from or relating to the subject matter of these Terms shall be resolved through binding arbitration in Milton Keynes, UK .
